Interest in International Arbitration: Brattle Principals Discuss in a New York Dispute Resolution Lawyer Article

Brattle Principals M. Alexis Maniatis, Florin Dorobantu, and Fabricio Nuñez have coauthored an article on the importance of interest in international arbitration, which has been published in the New York State Bar Association’s (NYSBA’s) New York Dispute Resolution Lawyer.
The article, “The Underappreciated Importance of Interest: DIA and Vale S.A. v. BSG Resources Limited,” highlights why interest – which compensates injured parties for the financial losses suffered due to delays between the time of the loss and the subsequent payment – can be a significant part of the award and yet receives little attention in international arbitrations. The authors highlight the need to match risk and return when awarding interest and use lessons learned from the Vale v. BSG award to illustrate how to approach the issue of interest with the intellectual and economic rigor it deserves.
