Brattle Principal Benjamin Sacks will present at Juris Conferences’ 12th Annual Investment Treaty Arbitration Conference, taking place March 6, 2018 in Washington, DC.
The event will cover topics, including compliance with local law clauses, parallel proceedings, and hot tubbing valuation experts.
Mr. Sacks will present during the panel discussion “To Hot Tub or Not to Hot Tub?” Valuation experts, as with arbitration counsel, often see the same “usual suspects” appear over and over again in hearings. Although there is nothing untoward about counsel as hired gun, some would argue that it’s inimical to the role of expert for valuators to be seen as hired guns, or as de facto extensions of the litigation team. Mr. Sacks and his co-panelists will discuss what would happen if tribunals mandated hot tubbing valuators, or having concurrent expert testimony, to generate an atmosphere more conducive to cooperation.
