Brattle Engagement Nominated for Global Competition Review Awards 2023 “Matter of the Year”
US Airways (American Airlines) v Sabre, a case in which a Brattle team provided expert analysis and trial testimony on behalf of US Airways, is a nominee in the Global Competition Review (GCR) Awards 2023. The case is nominated for “Matter of the Year: Merger Control, Cartel, Unilateral Conduct, Litigation, or Any Other Competition Matter Worldwide,” a category that honors “creative, strategic, and innovative work by teams of in-house and external lawyers and economists.”
Working with O’Melveny & Myers LLP, Yetter Coleman LLP, and American Airlines in-house legal team to analyze claims that Sabre had illegally monopolized a market for airline booking services using its computer network, a Brattle team developed bespoke economic models to demonstrate liability and measure damages. At trial, Principal Dr. Rosa M. Abrantes-Metz and Nobel laureate Prof. Joseph E. Stiglitz testified before a jury on Section 2 liability and damages relating to multi-sided platforms.
Following jury deliberations, US Airways prevailed on its Section 2 monopolization claim. Although US Airways was only awarded $1 in damages, the Brattle team successfully showed that Sabre’s actions were anticompetitive and monopolistic.
